This privacy policy will explain how Cardiff Wellbeing Support Service (CWSS) uses the personal data we collect from you when you engage with our services for wellbeing support.
CWSS is part of Cardiff Council, who is the Data Controller for the purposes of the data collected. All personal data is processed in accordance with the UK GDPR and Data Protection Act 2018.
What data do we collect?
CWSS collects the following data:
- Name
- Address
- Post Code
- Gender
- Email Address
- Date of Birth
This is collected for the purpose of assessing your support needs and create an action plan as to how we can support you to improve these needs. We will also use these details to contact you to advise you of any support services you may be interested in.
Data Protection law describes the legal basis for our processing your data as necessary for the performance of: (e) Public task: the processing is necessary for you to perform a task in the public interest or for your official functions, and the task or function has a clear basis in law.
Legislation: Social Services and Well-being (Wales) Act 2014
CWSS collects the following special category data:
- Disability Data
- Physical Mental Health
CWSS processes special category under Article 9 (2): (g) Reasons of substantial public interest (with a basis in law) under Schedule 1 condition 6: Statutory and government purposes.
CWSS collects the following special category data with your explicit consent:
CWSS collects the following sensitive data: This data is collected for the purpose of assessing whether CWSS is the appropriate support service for you.
- Child Protection
- Safeguarding Adults
- Criminal Offence Data
CWSS processes criminal offence data under:
- Schedule 1 Part 1 Condition 6: is necessary for reasons of substantial public interest.
- Schedule 1 Part 2 Condition 18: Safeguarding of children and of individuals at risk.
- Schedule 1 Part 3 Condition 30: Protecting individual's vital interests.
How do we collect your data?
You directly provide CWSS with most of the data we collect. We collect data and process data when you:
- Voluntarily engage with CWSS.
CWSS may also receive your data indirectly from the following sources:
- Third party organisations who refer you to our services.
How will we use your data?
CWSS collects your data so that we can:
- assess your needs and provide the most effective support.
Who do we share your data with?
If you consent, CWSS will share your data with third party organisations that will be able to offer you their support and services.
You can withdraw your consent to share with third party organisations at any time by emailing Wellbeingteam@cardiff.gov.uk or you can speak to your mentor.
How do we store your data?
CWSS securely stores your data on Cardiff Council password protected systems.
CWSS will keep a record of your support for 2 years. Once this time period has expired, we will delete your data.
What are your data protection rights?
CWSS would like to make sure you are fully aware of all of your data protection rights. Every user is entitled to the following:
The right to access
You have the right to request CWSS for copies of your personal data.
The right to rectification
You have the right to request that CWSS correct any information you believe is inaccurate. You also have the right to request CWSS to complete the information you believe is incomplete.
The right to erasure
You have the right to request that CWSS erase your personal data, under certain conditions.
The right to restrict processing
You have the right to request that CWSS restrict the processing of your personal data, under certain conditions.
The right to object to processing
You have the right to object to CWSS's processing of your personal data, under certain conditions.
The right to data portability
You have the right to request that CWSS transfer the data that we have collected to another organization, or directly to you, under certain conditions.
