How to appeal after a Notice to Owner

If you have received a Notice to Owner you are entitled to formally appeal by making representations within 28 days. If your representations are received after 28 days then they may not be considered. Please do not pay if you intend to appeal. The penalty will not increase while your representations are reviewed.

Once we have acknowledged receipt of your representations the case will be put on hold pending a decision from a case officer, which will be sent to you within 56 days.

Remember: The owner or hirer of the vehicle remains liable even if they were not driving at the time of the contravention.

Ensure that you include your return address and Penalty Charge Notice number with your representations along with your vehicle registration mark and any evidence you feel may support your case. Representations cannot be resolved over the telephone or in person and must be made online or in writing.

Your representations must be true to the best of your knowledge. Making false representations is a criminal offence and you may be prosecuted if you do.

Any information provided will be processed in accordance with the General Data Protection Regulation (GDPR)
. The authority or other relevant bodies may use any information you provide for enforcement purposes, fraud detection or for any other related purposes as permitted by law.

The Independent Adjudication Service

If the Council rejects your post-Notice to Owner appeal you are entitled to have the matter considered by an independent adjudicator from the Traffic Penalty Tribunal. The Notice of Rejection will contain instructions on how to appeal to the Tribunal and a unique appeal code. 

The adjudicator is completely independent from the Council. Their decision is final and legally binding on both the appellant and the Council.
