How to appeal a Moving traffic fine

You are entitled to appeal the Penalty Charge Notice (PCN) within 28 days. Any appeal received after this 28 day period may not be considered.

Please do not pay if you intend to make representations.


Once we have acknowledged receipt of your representations the case will be put on hold pending a decision from a case officer, which will be sent to you within 56 days.

Remember: The owner or hirer of the vehicle remains liable even if they were not driving at the time of the contravention.

Ensure that you include your return address and Penalty Charge Notice number with your representations along with your vehicle registration mark and any evidence you feel may support your case. Don’t forget to inform us if you change address before your representations are decided. Representations cannot be resolved over the telephone or in person and must be made online or in writing.  

Your representations must be true to the best of your knowledge. Making false representations is a criminal offence and you may be prosecuted if you do. 


Any personal information you provide will only be processed, shared and retained in accordance with current data protection legislation. 




 

No, payment is considered an admittance of liability. 

The moment we receive your appeal the case will be put on hold pending a decision. The penalty will not increase while your appeal is considered. 

If the Council rejects your appeal you are entitled to have the matter considered by an independent adjudicator from the Traffic Penalty Tribunal.

The Notice of Rejection will contain instructions on how to appeal to the Tribunal and a unique appeal code.

If you choose to appeal to the tribunal, you will no longer be entitled to pay the reduced penalty of £35.00. The adjudicator is completely independent from the Council and their decision is final.

Unlike a speeding fine, the person or company named on the PCN is solely responsible for it.

This is because the law makes the owner liable for the charge unless the vehicle was on hire.

For this reason you should not appeal on the basis that you were not driving or provide the Council with the name of the driver as this will not change anything and you will still remain liable.
